Florida Statue 318.14(9) prohibits anyone possessing a
"Commercial Drivers License (CDL) from taking the 4 hour "Basic
Driver Improvement Course" to remove points from their driving
record. In some cases, the CDL holder may be required to take
the course even though the points will still be accessed.
Many trucking companies will dismiss any driver with points on
their record. This creates a hardship on the trucker and the
company, but insurance companies will raise the trucking
companies insurance rates thereby placing a hardship on the
driver and the company. Is there any solution that can help
both? The answer is "YES".
The driver will need to contact the judge of traffic court and
submit a request to be required to take the Basic Driver
Improvement Course and withhold adjudication. By withholding
adjudication the points will not be assesed and the truckers
driving record will be clear of points for that particular violation.
